How to send a copyright notice
A copyright owner or someone authorized to act for the owner may send a written notice about material on PlanBill. A notice under 17 U.S.C. § 512(c)(3) should include:
- A physical or electronic signature of the copyright owner or an authorized agent.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material to be removed or disabled, with information that lets us locate it, such as the page or file URL.
- Contact information, such as a mailing address, telephone number, and email address.
- A statement that the sender has a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information is accurate and, under penalty of perjury, that the sender is authorized to act for the owner of the exclusive right allegedly infringed.
We may remove or disable access to material identified in a notice and may notify the account holder who uploaded it. Knowingly making a material misrepresentation in a notice may have legal consequences.
How to send a counter-notice
If we remove your material after a copyright notice, you may send a written counter-notice to the designated agent. Under 17 U.S.C. § 512(g)(3), it should include:
- Your physical or electronic signature.
- Identification of the material removed or disabled and where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief the material was removed or disabled because of a mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the federal district court for the district where your address is located, or, if outside the United States, any district where PlanBill may be found.
- A statement that you will accept service of process from the person who sent the notice or that person’s agent.
We may send the counter-notice to the person who submitted the original notice. If the designated agent receives no notice that the original sender has filed an action seeking a court order, the material may be restored between 10 and 14 business days after the counter-notice is received, as provided by law.
Repeat-infringer policy
Ecle Coastal LLC d/b/a PlanBill maintains and reasonably implements a policy that provides for account termination in appropriate circumstances when subscribers or account holders repeatedly infringe copyrights. We may also restrict access to material that violates our Acceptable Use Policy.
